Important Update: Changes to the Property Law Act 2023
The Property Law Act 2023 will commence tomorrow 1 August 2025, bringing significant reforms to conveyancing and property transactions in Queensland. These changes modernise the law, replacing the outdated 1974 Act, and introduce clearer processes for contracts, electronic conveyancing, disclosure obligations, and dispute resolution. For property conveyancing transactions, the new Act has significantly altered the disclosure obligations in a transaction, shifting the previous position of ‘buyer beware’ to a Seller disclosure position which is in line with the Southern States. This places significantly more risk on the Seller and contracts will now contain much more detail than was previously required. Buyers and sellers should be aware of the updated requirements as they impact not only contract preparation, but timeframes, and settlement procedures. These reforms aim to improve transparency and efficiency in property dealings for the benefit of all.
